What constitutes a drain? What constitutes a sewer?
Drains and sewers often become blocked and there is often confusion over the responsibility. Initially it has to be determined whether the problem is in a sewer or a drain.
When and why does the council become involved?
In the interests of maintaining public health, the council has powers to insist that blockages are removed and repairs made to a drain or private sewer.
It is a common misconception that the Council is responsible for maintaining drains, however apart from some drainage on Council owned property (bear in mind that the Council have transferred ALL houses to Walsall Housing Group) the Council does not have a responsibility to carry out clearance or repairs.
All drains and sewers are either the responsibliity of the property owner or (for most pre 1937 drainage) are the responsibility of the Statutory undertaker (Severn Trent Water.)
